Welcome to BuhayAhente ("Platform", "Service", "we", "our", or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service.

If you do not agree with these terms, please do not use the Platform.

1. About BuhayAhente

BuhayAhente is a Software-as-a-Service (SaaS) platform that helps:

  • Car Sales Agents
  • Marketing Professionals
  • Buy and Sell Businesses
  • Freelance Agents
  • Small Car Dealership Owners

manage their online presence, vehicle listings, quotations, and customer inquiries.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years old;
  • Provide accurate and complete registration information;
  • Have the legal capacity to enter into agreements.

3. Account Registration

When creating an account, you agree to:

  • Provide truthful information;
  • Keep your login credentials secure;
  • Be responsible for all activities under your account.

You are solely responsible for maintaining the confidentiality of your password.

4. Email Verification

Certain features may require email verification. We reserve the right to suspend or terminate accounts that use invalid or fraudulent email addresses.

5. Free Trial

BuhayAhente may offer a free trial period that provides access to premium features.

We reserve the right to:

  • Modify the duration of the trial;
  • Limit features during the trial;
  • End the trial at any time if abuse or fraudulent activity is detected.

After the trial expires, some features may become unavailable until a subscription plan is activated.

6. Subscription Plans

Paid plans may include:

  • Starter Plan
  • Premium Plan
  • Professional Plan

Subscription fees are displayed on the Platform and may change without prior notice.

Failure to complete payment may result in:

  • Suspension of premium features;
  • Downgrading of your account;
  • Temporary restriction of access.

7. User Content

You retain ownership of all content you upload, including:

  • Vehicle photos;
  • Logos;
  • Business information;
  • Documents;
  • Quotations;
  • Marketing materials.

By uploading content, you grant BuhayAhente a non-exclusive license to store, display, and process such content solely for providing the Service.

8. Prohibited Activities

You agree NOT to:

  • Use the Platform for illegal activities;
  • Upload false or misleading vehicle information;
  • Impersonate another person or business;
  • Upload malicious software or harmful code;
  • Attempt unauthorized access to our systems;
  • Use the Platform to spam users.

Violation of these rules may result in immediate account termination.

9. Intellectual Property

All software, branding, logos, designs, and platform features of BuhayAhente remain the exclusive property of BuhayAhente and its owners.

You may not:

  • Copy;
  • Resell;
  • Reverse engineer;
  • Modify;
  • Distribute

any part of the Platform without written permission.

10. Service Availability

We strive to provide uninterrupted service but do not guarantee:

  • Continuous availability;
  • Error-free operation;
  • Compatibility with all devices or browsers.

Maintenance, upgrades, or technical issues may temporarily affect service availability.

11. Data Backup

While we implement reasonable backup procedures, users are encouraged to maintain copies of important information and documents.

BuhayAhente shall not be liable for loss of data caused by:

  • User error;
  • System failures;
  • Internet disruptions;
  • Force majeure events.

12. Account Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms;
  • Fraudulent activities are detected;
  • Required payments remain unpaid;
  • The account poses security risks.

13. Limitation of Liability

To the fullest extent permitted by law, BuhayAhente shall not be liable for:

  • Loss of profits;
  • Loss of business opportunities;
  • Indirect damages;
  • Consequential damages;
  • Data loss.

Your use of the Platform is at your own risk.

14. Indemnification

You agree to indemnify and hold harmless BuhayAhente, its owners, employees, and affiliates from claims arising from:

  • Your misuse of the Platform;
  • Violation of these Terms;
  • Violation of applicable laws.

15. Changes to the Terms

We may update these Terms at any time.

Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms shall be subject to the jurisdiction of the appropriate courts of the Philippines.
